Terms and conditions

Ahhh Terms & Conditions, you've gotta love’em, but it’s important you read and understand our Terms and Conditions before ordering from Sketch Your Pet, because in ordering from Sketch Your Pet you agree to our Terms and Conditions.

 

Sketch Your Pet provides an artistic service to customers who wish to have photos of their pets transformed into cute caricatures. Customers order online through this website or are invoiced privately by Sketch Your Pet. 

 

Sketch Your Pet reserves the right to update, change or replace any part of these Terms and Conditions by posting updates to our website at any date or time.

 

1. Orders

All Orders for Goods made by you will be subject to these Terms and Conditions.

 

We require full payment in advance before we commence work on your order.

 

Once you’ve placed your order you can cancel your order for a full refund so long as we haven’t commenced work on your illustration. You have 72 hours from the time you placed your order to cancel your order, after this time we will assume you wish to proceed and will start work on your order. I cannot stress enough how important it is that if for any reason at all you wish to cancel your order you comply with these terms or else you lose the right for a refund.

 

If once you’ve placed the order you wish to upgrade your order from, as an example, a sketch to a colour illustration so long as you pay the extra cost and we have not yet started your sketch we would be happy to amend your order.

 

2. Prices and payment

The prices of our products are displayed on our website and we reserve the right to amend these prices at our discretion at any given time.

Throughout the year we may run ‘promotions’ that discount our current prices, for a limited time, and we will clearly state how long this promotion runs for on our website. Once the promotional period has ended the prices will return to their original price. If you do not order within this ‘promotional period’ we are not at liberty to honour the ‘reduced’ prices and you will have to pay ‘full price’ for our goods.

Our Prices may change at any time but these changes will not affect any Orders that We have already accepted.

Our Prices exclude the cost of delivery. 

Sketch Your Pet currently offers two ways to pay. You can order directly through the website and pay safely and securely via PayPal. Alternatively, you can request to be invoiced privately by Sketch Your Pet by which we will request a direct bank transfer of the funds into a designated bank account of our choosing. 

 

3. Delivery

We use Royal Mail’s 1st and 2nd Class Signed For and Special Delivery Services, which are a signed for service which provides a tracking reference number, enabling you to track your shipped item(s).

We reserve the right to amend this amount as and when Royal Mail decide to make changes to their costs.

 

Please note that we currently only deliver within the United Kingdom, however, if you live in a different country please let us know where you live and we will aim to re-quote you for the cost of the delivery, as it’s normally more expensive to ship internationally. Email us with your request and we will aim to get back to you as soon as we can.

 

When we send you an order confirmation via email, we will provide an estimated delivery date. Please note that estimated delivery dates may vary according to the amount of orders we have at any given time and circumstances beyond our control.

 

If you have a special request for when you need your order please let us know as soon as you can so we can factor this into our delivery estimate. We will always attempt to get your order to you by the date you request but at times it simply isn’t possible and we will let you know as soon as we receive your request whether we’re able to get your order to you by the time/date you’ve requested.

 

If you fail to let us know when you need your order by and we are unaware of this date and miss this delivery date, we are not liable to issue you a refund for your order, so it is up to you to let us know as soon as you can.

 

Due to the nature of our small business, there is often a slight delay before your order will be completed. Sketches take approximately 1 week to complete and Colour Illustrations take anything up to 2-3 weeks. We prefer not to rush any projects and so we like to take a little extra time to complete your order. We keep you in the loop every step of the way via email or by phone via the contact details you provided when you ordered.

 

If your order is misplaced/lost/damaged by Royal Mail in some way and we receive confirmation from you and by Royal Mail we will endeavour to re-send your item and re-ship at no extra cost. If your item is a sketch it will need to be re-created which will take additional time to re-create from scratch. If this situation happens we ask that you be patient with us in getting your new sketch to you as we may have multiple orders on, and it may take some time to get your order to you.

 

4. Modifications

The prices and contents of our parties are subject to change and we reserve the right at any time to modify or discontinue any of our items without notice at any time.

 

5. Copyright

Sketch Your Pet is the owner or the licensee of all intellectual property rights contained on this site and in the material published on it. All such rights are reserved.

 

6. Complaints

If you have a complaint please get in contact with us immediately and we will endeavour to help you with your issue. Please use our contact form.

 

7. Our liability

We will be responsible for any foreseeable loss or damage that you may suffer as a result of our breach of these terms and conditions or as a result of our negligence.  Loss or damage is foreseeable if it is an obvious consequence of our breach or negligence or if it is contemplated by you and us when your order is created. We will not be responsible for any loss or damage that is not foreseeable.

 

We only supply Goods for domestic and private use. We make no warranty or representation that the Goods are fit for commercial, business or industrial use of any kind (including resale).  By making your order, you agree that you will not use the Goods for such purposes. We will not be liable to you for any loss of profit, loss of business, interruption to business or for any loss of business opportunity.

 

Nothing in these Terms and Conditions seeks to exclude or limit our liability for the following with respect to your rights as a consumer:

 

Breach of your right to title and quiet possession as implied by section 12 of the Sale of Goods Act 1979;

 

Breach of terms relating to description, satisfactory quality, fitness for purpose and samples as implied by sections 13, 14 and 15 of the Sale of Goods Act 1979;

 

Our liability relating to defective products as set out in the Consumer Protection Act 1987.

 

8. Events outside of our control (Force Majeure)

We will not be liable for any failure or delay in performing our obligations where that failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action, civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism, acts of war, governmental action, epidemic or other natural disaster, or any other event that is beyond Our control. If any event described under this Clause occurs that is likely to adversely affect our performance of any of our obligations under these Terms and Conditions:

  • We will inform you as soon as is reasonably possible;

  • Our obligations under these Terms and Conditions will be suspended and any time limits that We are bound by will be extended accordingly;

  • We will inform you when the event outside of our control is over and provide details of any new dates, times or availability of Goods as necessary;

    • If the event outside of our control continues for more than 2 months we will cancel the    contract and inform you of the cancellation.  Any refunds due to you as a result of that     cancellation will be paid to you as soon as is reasonably possible;

    • If an event outside of Our control occurs and you wish to cancel the Contract, you may    do so in accordance with your right to cancel.

If you wish to contact us with questions or complaints, feel free to use the Contact Us page here. In certain circumstances, you must contact us in writing (when cancelling an Order, for example). 10. How we use your personal information (Data Protection)

All personal information that We may collect (including, but not limited to, your name and address) will be collected, used and held in accordance with the provisions of the Data Protection Act 1998 and your rights under that Act.

  •  We may use your personal information to:

  •  Provide Our Goods and services to you;

  •  Process your payment for the Goods; and

  •  Inform you of new products and services available from Us. You may request that we stop    sending you this information at any time.

 

In certain circumstances (if, for example, you wish to purchase Goods on credit), and with your consent, We may pass your personal information on to credit reference agencies. These agencies are also bound by the Data Protection Act 1998 and should use and hold your personal information accordingly.

 

We will not pass on your personal information to any other third parties [without first obtaining your express permission].

 

11. Privacy

Sketch Your Pet takes your privacy very seriously, and we will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We only collect information from you to process your order and to be able to post your order to you. We will not send you any e-mail offers and product notifications unless you have given us your permission and we will always give you the chance to refuse any marketing email from us in the future. We will never sell your personal information to those annoying third-party people either.

 

12. Other important terms

You may not transfer (assign) your [other] obligations and rights under these Terms and Conditions (and under the Contract, as applicable) without our express written permission.

 

The Contract is between you and Us. It is not intended to benefit any other person or third party in any way and no such person or party will be entitled to enforce any provision of these Terms and Conditions.  

 

If any of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable by any court or other authority, that / those provision(s) shall be deemed severed from the remainder of these Terms and Conditions.  The remainder of these Terms and Conditions shall be valid and enforceable.

 

No failure or delay by Us in exercising any of Our rights under these Terms and Conditions means that We have waived that right, and no waiver by Us of a breach of any provision of these Terms and Conditions means that We will waive any subsequent breach of the same or any other provision.

 

13. Governing Law and Jurisdiction

These Terms and Conditions (and the Contract) (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.

 

Any dispute, controversy, proceedings or claim between Us and you relating to these Terms and Conditions (or the Contract) (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the non-exclusive jurisdiction of the courts of England and Wales.
